Toutiao Platform Infringement Complaint Guidelines
In view of the large amount of information released by third parties on the platform, Toutiao, as a network service provider, has formulated these guidelines in accordance with relevant laws and regulations in order to effectively protect the rights holders. If you, as a rights holder, believe that the information on the Toutiao platform infringes upon your legitimate rights and interests, you can notify us in accordance with these guidelines and we will handle it in accordance with the law.
1. Things to note
1 The right holder should provide a signed written notification and scanned copies of relevant supporting materials. In order to ensure the authenticity and validity of the relevant materials provided by the rights holder, Toutiao may require you to provide the originals of the above-mentioned materials when it deems necessary, and please cooperate in providing them at that time.
2. If the right holder has reasonable reasons for not being able to provide the original certification materials, a copy thereof should be provided (the copy should be signed by the right holder).
3. If the certification materials are formed in foreign countries or Hong Kong, Macao and Taiwan regions, notarization and certification or other legally required certification procedures should be carried out in the country or region where they are located in accordance with legal provisions.
4. If the right holder has initiated administrative or judicial dispute resolution procedures against the respondent, please submit the notice, relevant acceptance certificates, and evidence submitted to the dispute resolution agency to Toutiao, which will facilitate the handling of the complaint.
2. Process
1 Complaint Notice
If rights holders believe that certain content on the Toutiao platform is suspected of infringing upon their legitimate rights and interests, they may send a written notice of complaint to Toutiao. According to the "Civil Code of the People's Republic of China", the "Regulations on the Protection of the Right to Disseminate Information Networks", the "Provisions of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Civil Disputes Using Information Networks to Infringe Personal Rights and Interests" and other relevant judicial interpretations, the complaint notice must Contains the following content:
1.1 Right holder information and relevant supporting materials
(1) The right holder’s true identity information and contact information, such as photos or scanned copies of ID cards (for Chinese citizens) or passports (for foreign citizens), contact numbers, email addresses, etc.
(2) Unit complaints: Business license (stamped with official seal) and complaint notice (stamped with official seal), as well as contact person, contact number and email address.
(3) Complaining on behalf of others: In addition to the subject identity information and certification materials of both the complainant and the right holder required in (1) and (2) above, a power of attorney signed or sealed by the right holder and the name of the agent are also required. 1.2 Complaint matters

1.3 Preliminary proof of infringement

2 Handling of legitimate complaint notices
2.1 After Toutiao receives a complaint notice from the right holder that meets the legal requirements, it will take necessary measures in a timely manner based on the preliminary evidence of infringement and the type of service.
2.2 For complaint notices that do not meet statutory requirements, Toutiao has the right not to process them until the right holder makes corrections.
2.3 According to relevant legal provisions, Toutiao has the right to forward the complaint notice submitted by the complainant to the person being complained against. If the complaint notice contains personal information or sensitive information, it will be regarded as the complainant. Permission is granted to Toutiao to transfer this information.
2.4 If the respondent does not recognize the complainant’s infringement complaint, the respondent may issue a written explanation (hereinafter referred to as the “non-infringement statement”) to Toutiao; after receiving the respondent’s non-infringement statement that meets legal requirements, Toutiao , forward the respondent’s non-infringement statement to the complainant. If the complainant does not agree with the statement, he must submit rights protection materials to the platform within 10 days from the day after receiving the statement, including making a complaint to the relevant department or filing a lawsuit with the court.
